After another review by the Fifth Circuit, the temporary ban on the OSHA rule is now permanent. As a result, the Court concluded that the district court correctly dismissed the breach of contract claim. A three-judge panel at the Fifth Circuit Court of Appeals recently placed a temporary halt to Biden’s unconstitutional COVID-19 mandate on private employers. The Court of Appeals ruled that, while each of the policyholders was entitled to the fair market value of their pre-loss vehicle, that fair market value does not include the sales tax and fees remitted to the state in connection with purchasing a replacement vehicle. Pursuant to §230.40 of the CJA Guidelines and Section 6 of the Fifth Circuit’s Plan for Representation on Appeal under the Criminal Justice Act, no one appointed under the CJA may accept any payment from or on behalf of the person represented without prior authorization by a judge of the court of appeals. These less powerful courts are called United States district courts. The district court dismissed the complaint on Elephant Insurance Company’s motion, ruling that the policy did not require payment of sales tax and fees with actual cash value payments, and that plaintiffs therefore failed to state a claim for breach of contract. The Court of Appeals for the 5th Circuit is the appeals court that has jurisdiction, or legal power, to review cases decided by less powerful courts in the 5th Circuit.

The policyholders claimed that Elephant Insurance Company was liable for breach of contract and for violating provisions of the Texas Insurance Code that required prompt payment of claims when it failed to pay them sales tax and fees on their total loss vehicles.
